2013-08-13 | CHR Solutions Inc, Derek Engineering of Ohio Inc, Richard Pohana, Peters Engineering | Board Accepts Settlement Agreements in Four Cases 

At its meeting on August 13, 2013 the State Board of Registration for Professional Engineers and Surveyors accepted settlement agreements from CHR Solutions, Inc., Peters Engineering, Derek Engineering of Ohio, Inc., and Richard Pohana, P.E.

CHR Solutions, Inc., located in Mitchell, South Dakota, provided engineering services in Ohio at a time when the firm did not possess a Certificate of Authorization from the Board to provide engineering services in Ohio.

Peters Engineering, located in Sacramento, California, provided engineering services in Ohio at a time when the firm did not possess a Certificate of Authorization from the Board to provide engineering services in Ohio.

Derek Engineering of Ohio, Inc., located in Cincinnati, Ohio, entered into a settlement agreement wherein the firm agreed to permanently remove the term Engineering from its name and will not offer or provide engineering services until the firm has been granted a Certificate of Authorization from the Board.

Richard Pohana, P.E., a resident of Cincinnati, Ohio, engaged in the unlicensed practice of engineering by performing engineering work and affixing his engineering seal to five engineering documents for projects located in Ohio at a time when his professional engineer registration was expired.

At its meeting on July 16, 2013, the Ohio State Board of Registration for Professional Engineers and Surveyors accepted settlement agreements from AW Solutions, Inc., Technical Surveying Services, LLC, Theodore A. Lapponi, P.E. and Michael Fisher.

AW Solutions Inc., located in Longwood, Florida, provided engineering services in Ohio at a time when the firm did not possess a Certificate of Authorization with this Board.

Technical Surveying Services, LLC, located in New Philadelphia, Ohio, provided surveying services in Ohio at a time when the firm’s Certificate of Authorization was expired.

Theodore A. Lapponi, PE, a resident of North Ridgeville, Ohio, engaged in the unlicensed practice of engineering on two (2) projects in Ohio at a time when his professional engineer registration was expired.

Michael Fisher, a resident of Cincinnati, Ohio, engaged in the illegal practice of engineering and plead guilty to one (1) count of forgery, a felony, for forging the seal and signature of an Ohio registered professional engineer on structural engineering plans.

At its meeting on July 16, 2013 the Ohio State Board of Registration for Professional Engineers and Surveyors issued a final order revoking the professional engineer registration of Frank P. Knapp.

Frank P. Knapp, a resident of Delaware, Ohio, was charged with failing to provide evidence that he completed Ohio’s continuing education requirement for professional engineers.

2013-05-28 | Paul Dey, Jayme Malone | State Board Issues Final Orders

At its meeting on May 28, 2013 the Ohio State Board of Registration for Professional Engineers and Surveyors issued Final Orders to Jayme M. Malone and Paul E. Dey. 

Jayme M. Malone, P.S., a resident of Lincoln, Nebraska, was charged with violations of Ohio Revised Code Sections 4733.20 (A) (2) & (5) and Ohio Administrative Code Sections 4733-35-07 and 4733-35-08 based on his voluntarily surrendering of his professional surveying license in Oklahoma as if it had been revoked.

Paul E. Dey, P.E., a resident of Medina, Ohio, was charged with violations of Ohio Revised Code Sections 4733.11 (E), 4733.20 (A) (2), (4) & (5) and Ohio Administrative Code Sections 4733-35-02 and 4733-35-08 based on his plea of guilty in the Cuyahoga County Court of Common Pleas, Cleveland, Ohio to one count of Tampering with Records, a fourth degree felony.

2013-05-28 | Warren Drescher, JF New & Associates dba Cardno JFNew, Vincent Obmann, Structural Concepts Engineering Inc | State Board Accepts Settlement Agreements

At its meeting on May 28, 2013 the Ohio State Board of Registration for Professional Engineers and Surveyors accepted settlement agreements from Warren F. Drescher, IV, Vincent C. Obmann, Structural Concepts Engineering, Inc. and J.F. New & Associates dba Cardno JFNew.

Warren F. Drescher, IV, P.S., a resident of Youngstown, Ohio, failed to comply with the Minimum Standards for Mortgage Location Surveys (Ohio Administrative Code 4733-38) for a mortgage survey he performed in Cortland, Ohio.

Vincent C. Obmann, a resident of Alliance, Ohio, represented himself as an Electrical Engineering Consultant in Ohio at a time when he did not possess a registration as a professional engineer with this Board.

Structural Concepts Engineering Inc., located in Anaheim, California, provided engineering services in Ohio at a time when the firm did not possess a Certificate of Authorization with this Board.

J.F. New & Associates dba Cardno JFNew, located in Walkerton, Indiana provided engineering services in Ohio at a time when the firm did not possess a Certificate of Authorization with this Board.

Download new release PDF Download news release DOC 2013-03-21 Daniel Cook, Bruce DiFrancisco, Mark Patterson, Lodovico Spinabelli State Board Accepts Settlement Agreements

At its meeting on March 21, 2013 the Ohio State Board of Registration for Professional Engineers and Surveyors accepted settlement agreements from Mark E. Patterson, Daniel J. Cook, Lodovico “Vic” Spinabelli, Jr. and Bruce E. DiFrancisco. 

Mark E. Patterson, a resident of Louisville, Kentucky, failed to disclose disciplinary action taken against his professional surveyor registration by the Kentucky Board of Engineers and Land Surveyors on his application for registration as a professional engineer in Ohio.

Daniel J. Cook, a resident of Akron, Ohio, failed to adhere to the Standards for Mortgage Location Surveys (Ohio Administrative Code 4733-38) for a mortgage survey he performed in Solon, Ohio. 

Lodovico “Vic” Spinabelli, Jr., a resident of Broadview Heights, Ohio, represented himself as a professional engineer in Ohio at a time when he did not possess a registration with this Board.

Bruce Edward DiFrancisco, P.E., a resident of North Royalton, Ohio, engaged in the unlicensed practice of engineering on three (3) projects at a time when his professional engineer registration was expired.

At its meeting on February 21, 2013 the Ohio State Board of Registration for Professional Engineers and Surveyors accepted settlement agreements from Steve H. Hepp, Geopier Foundation Company Inc., Marshall Miller & Associates dba Cardno MM&A and Gregory N. Winters. 

Steve H. Hepp, a resident of Russells Point, Ohio, was the subject of an investigation after the Board received information that Hepp had prepared engineering drawings and used a forged seal and signature of a registered professional engineer on the drawings.

Geopier Foundation Company, Inc., located in Alpharetta, GA, provided engineering services in Ohio at a time when the firm did not possess a Certificate of Authorization with this Board.

Marshall Miller & Associates dba Cardno MM&A, located in Bluefield, VA, provided engineering services in Ohio at a time when the firm did not possess a Certificate of Authorization.

Gregory N. Winters, P.S., a resident of Bay Village, Ohio, was randomly selected for the Board’s continuing professional development audit. Winters failed to provide documentation as required.
